MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: Petition of Constantinos Mitrokostas for a Special Permit SP-90-53 <br /> A Petition was filed by Constantinos Mitrokostas of West Yarmouth, <br /> Massachusetts for a Special Permit under Section 174-25.E.2 of the <br /> Zoning By-laws for permission to operate a restaurant in a C-2 <br /> zoning district on property located at 401 Nathan Ellis Highway <br /> and 34 Sassacus Road (Map 72, Blocks 57 and 58) Mashpee, Massachusetts. <br /> (Owner of record: Alexander and Ecaterini Mitrokostas) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on June 25 and July 2, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 11, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Mr. Mitrokostas represented the Petition. He reviewed plans <br /> for the proposed restaurant for pizza and Greek food. He explained <br /> that Town water will not be available at the site until 1991 and <br /> he has purchased an adjacent lot to install a non-community public <br /> well to service the restaurant. Elias McQuaid, health agent, <br /> stated that the restaurant will not be licensed until the final <br /> approval of the well is received by the Board of Health. <br /> The Board determined that the Petitioner met the conditions <br /> necessary for the granting of a Special Permit. The Board found <br /> that the use is in harmony with the general purpose and intent <br /> of the Zoning By-laws and complies with the provisions thereof. <br />
