14. Upon information and belief, the Defendants propose to locate <br /> a restaurant at the Property consisting of fifty-seven hundred <br /> (5700) square feet with a seating capacity of one hundred <br /> fifty-eight (158) patrons. <br /> 15. Access to the Property will be from Ryans Way on the North and <br /> via a connector from the adjacent Stop & Shop commercial <br /> Shopping Center on the South. <br /> 16. The property has a combined frontage in excess of four hundred <br /> and fifty (450) feet on both of the ways which abut the <br /> parcel. <br /> 17. A public hearing was held by the Mashpee Zoning Board of <br /> Appeals on the applications of the Defendant on February 28, <br /> 1996. The hearing was continued to March 27 and April 10, <br /> 1996. <br /> 18 . At the hearing held on April 10, 1996, the Board of Appeals <br /> voted to grant a special permit and a variance to allow <br /> internal illumination of a free standing sign with a maximum <br /> square footage of forty-five (45) feet, height of ten (10) <br /> feet, ten (10) inches to the top of the logo, side base of <br /> three (3) feet, six (6) inches from the grade and to be placed <br /> twelve (12) feet from the lot line. <br /> 19 . The Decision of the Board of Appeals granting the variance was <br /> filed with the Town Clerk of the Town of Mashpee on April 23 , <br /> 1996. An attested copy is attached hereto and incorporated <br /> herein as Exhibit "A". <br /> 20. The Decision of the Board of Appeals granting the special <br /> permit was filed with the Town Clerk on April 23 1996. An <br /> attested copy is attached hereto and incorporated herein as <br /> Exhibit "B" . <br /> 21. The Plaintiffs are aggrieved by the Decisions of the Board of <br /> Appeals and are persons aggrieved within the meaning of G. L. <br /> c. 40A, Section 17. <br /> COUNT I <br /> 22.
