tY <br /> I <br /> SECTION 1 : PL R_ SE AND VALIDITY <br /> 1 .1 Zoning Purposes <br /> For the purposes set forth in Massachusetts General Laws, <br /> Chapter 40A and all Acts in amendment thereof , and in addition <br /> thereto , and under the authority thereof , the height, area, <br /> location and use of buildings and structures and the use of <br /> r <br /> land throughout the Town of Mashpee are hereby regulated as <br /> provided herein, and the Town is hereby divided into districts <br /> hereinafter designated , defined and described, and shown on <br /> ;- an official copy of the zoning map, dated May, 1979 as amended , <br /> i' on file with the Town Clerk, which map is hereby made a part <br /> of this By-Law. <br /> L«o <br /> F; <br /> 1. 2 Conflict of Laws, Validity, Severability <br /> t; <br /> 1.21 In general , this By is supplementary to other Town By-Laws <br /> affecting the use, height, area and location of buildings and <br /> use of premises, but where this By-Law imposes a greater re- <br /> ji�r striction in any respect than is imposed by other Town By-Laws, <br /> the provisions of this By-Law shall prevail. <br /> 1 .22 The invalidity of any section or provision of this By-Law shall <br /> not invalidate any other section or provision. <br /> '13 <br /> SECTION 2 : DEFINITIONS <br /> p_ <br /> For the purposes of this By-Law the following words and phrases <br /> shall have the meanings or limitations of meanings herein defined. <br /> All present tenses shall include past and future tenses and all past <br /> tense the present. All singular terms shall include the plural and <br /> m the plural the singular. <br /> '2. 1 Accessory <br /> a) Accessory building: a building devoted exclusively to a <br /> use accessory to the principal use of the lot on which it <br /> is located. <br /> b) Accessory use: a use incident and subordinate to and on <br /> the same lot as a principal use, <br /> 2.2 Apar tmen t <br /> a) Unit: any room or suite of rooms forming a habitable unit <br /> n for one f amil y with its own cooping and food storage equip- <br /> ment and its own bathing and toilet facilities and its own <br /> it living , sleeping, and eating areas wholly within such room <br /> or suite of rooms . <br /> b) Apartment building: a building containing four or more <br /> apartment units. <br /> c) Garden. apartment: an apartment building containing four <br /> or more apartment units with no portion of the building <br /> below the first story or above the second story used for <br /> dwelling purposes . <br /> -1- <br />
