aforesaid, or the making of loud outcries, <br /> exclamations or other loud or boisterous noises <br /> or loud and boisterous singing by any person or <br /> group of persons or in the use of any device to <br /> amplify the aforesaid noise, where the noise is <br /> plainly audible at a distance of 150 feet or more <br /> from the building, structure, vehicle, or premises <br /> in which or from which it is produced. Any person <br /> violating this by-law shall be punished by a fine <br /> Of not more than $50 . 00 for each offense. <br /> b. Any person who is present in any building, dwelling, <br /> shelter, boat , conveyance, or premises or any part <br /> thereof at any time when a violation of By-Law 4 . 5 . 1a <br /> occurs shall be deemed to have made, aided, caused, j <br /> suffered, countenanced, or otherwise assisted in the ' <br /> making of the said improper noises and shall be punish- <br /> ed by a fine of not more than $50. 00 for each offense. <br /> ection 4. 5 . 2 Alcoholic Beverages - Minors . It shall be unlawful <br /> Tor any person who-ha:-snot-attained the age as deter- <br /> mined, from time to time, by the General Court of <br /> the Commonwealth of Massachusetts as being the lawful <br /> age for consumption of alcohol to consume or knowingly <br /> i <br /> have in his or her possession alcoholic beverages on <br /> public highways, including vehicles thereon, or in <br /> public places within the Town of Mashpee. Whoever <br /> violates the provisions of this by-la;v shall be fined <br /> in an amount not exceeding $50. 00 for each offense. <br /> ection 4. 5 . 3 Disorderly Conduct <br /> ction 4. 5. 3. 1 Definition . "Public Place" shall mean any place, <br /> structure or building to which the general public has <br /> access and a right to resort for business, entertainment, <br /> or other lawful purpose, but does not necessarily mean <br /> a place devoted solely to the uses of the public . It <br /> shall also include the front, parking lot or immediate <br /> area of any store, shop, restaurant, tavern, or other <br /> place of business and also public grounds, areas, parks <br /> and beaches . I <br /> ction 4. 5. 3. 2 Disorderly Conduct Prohibited. A person shall be guilty <br /> of disorderly conduct if, with the purpose of causing <br /> public danger, alarm, disorder, nuisance, or if his j <br /> conduct is likely to cause public danger, alarm, disorder <br /> or nuisance, he willfully does any of the following <br /> acts in a public place : <br /> a. Commits an act in a violent and tumultuous manner <br /> toward another whereby that other is placed in <br /> danger of his life, limb or health; <br /> b. Commits an act in a violent and tumultuous manner <br /> towards another whereby the property of any person <br /> is placed in danger of being destroyed or damaged; <br /> C . Causes , provokes or engages in any fight, brawl or <br /> riotous conduct so as to endanger the life, limb, <br /> health, or property of another. <br /> 23 - <br />
