Before the expiration of f� ! said year , the Town of Ma_•hpee shall upon its initiative or, upon the request of the organization I theretofore responsibile for the maintenance of the open =pace , call a public hearing upon notice to such a organization , or to the residents of the j the open space residential development , to be held by the Town of Ma=hpee Planning Board, at ,-,ih i r_h hearing such organization or the residents of the open space regi dent i a1 deveI opment shat l show c-suse U:rhy such maintenance by the T��i.vn of Ma.shpee shall not , at the election of the Tot.Un of !•lashpee , continue for a succeeding year . If the Planning Board of. Town of M.ashpee shall determine that such organization is ready and able to maintain :said open space in reasonable condition , the Town of Mashpee shall cease to maintain said open space at the end of said year . If the Planning Board of of the Tor:,in of Mashpee shall determine such organization is not r?.a.d,,, .and able to maintain said open space in reasonable condition , the Town of Ma_•hpee may, in its discretion , continue to maintain said open space during the next j succeeding Year. and subject to a similar hearing and determination , in each year thereafter . The decision of the P1 ann i ng Board of the Tok-,)n of Ma-shpee in any such case shall constitute a. final administrative decision subject to review in accordance vii th any appl i c.abl e statue of the Commonweal th of Massachusetts . The cost of such maintenance by the To+..Jn � Mashpee shall be assessed pro rata against the properties v)ithin the open space residential development that have { right of enjo::,ment of the ` open space , such assessment shall become a l e i n on properties .
