If the Planning <br /> Board of. Town of M.ashpee shall determine that such <br /> organization is ready and able to maintain :said <br /> open space in reasonable condition , the Town of <br /> Mashpee shall cease to maintain said open space at <br /> the end of said year . If the Planning Board of <br /> of the Tor:,in of Mashpee shall determine such <br /> organization is not r?.a.d,,, .and able to maintain <br /> said open space in reasonable condition , the Town <br /> of Ma_•hpee may, in its discretion , continue to <br /> maintain said open space during the next <br /> j succeeding Year. and subject to a similar hearing <br /> and determination , in each year thereafter . The <br /> decision of the P1 ann i ng Board of the Tok-,)n of <br /> Ma-shpee in any such case shall constitute a. final <br /> administrative decision subject to review in <br /> accordance vii th any appl i c.abl e statue of the <br /> Commonweal th of Massachusetts . <br /> The cost of such maintenance by the To+..Jn � <br /> Mashpee shall be assessed pro rata against the <br /> properties v)ithin the open space residential <br /> development that have { right of enjo::,ment of the ` <br /> open space , such assessment shall become a l e i n on <br /> properties .
