THE COMMONWEALTH OF MASSACHUSETTS
T014N OF MASHPEE
BOARD OF APPEALS
JMarch -24
............. 29...71.
Decision of the Board of Appeals on the appeal and petition of..............................................
MODULAR--STCTURE
RUS.I...INC' ....
Hearing was held January 6, 1971. Present were Philip A.
Rollins, Peter Lawrence, Chairman, and Frank E. Hicks.
This is an application for a special permit brought under
Mashpee By-laws (Zoning) , Section FII (b) , by Modular Structures,
Inc. Petitioner seeks permission to construct 33 apartment houses
buildings containing 240 dwelling units, with tennis courts, swim-
ming pools, parking areas, and other amenities.
Petitioner was represented by Counsel at the hearing and
presented evidence in its own behalf as well.
After due consideration, it is the unanimous opinion of the
Board of Appeals that the application should be denied, for the
following reasons :
(1) Petitioner' s proposed use involves a parcel of land of
about 30 acres abutting Route 28 and has an average depth of
about 300 feet. The proposal would ,naturally increase the flow
of vehicular traffic to and from the highway, so as to increase
road hazards in an area already beset with serious traffic
problems.
(2) Proposed use is substantially trimental to the overall
development of the area involved, pa ticular y in terms of
increased population density.
o —
rover
1095 roeoe o w.wwam.irc.
