THE COMMONWEALTH OF MASSACHUSETTS
TOWN pg` MASHPEE
130A FUD OF AF'PEAILS
----Mar r h..15+..............................19-.22...
Decision o_f the Board of Appeals on the appeal and petition of..............................................
Miner C. Pederson r
..........---.........................._.........................:... _.............................................. ................... ........
Hearing: February 9, 1972, 8 p.m. , Mashpee Town Hall
Board Members: Peter M. Lawrence
Clara Keliinui
Kevin D. O'Connell
The petition of Miner G. Pederson for a variance to construct a storage building
on Lot #4 Seconsett involves two variances from the zoning by-laws. The petition
asks for a variance of 13 feet from the front yard depth requirements , and 10 feet
from side line requirement.
The proposed storage garage is situated on a lot of approximately one acre., more or
less, and containing some marshland. The proposed building, as per plan, has a
12 foot set back from the front line and a 5 foot set back from the side line.
The Board feels that the size of the lot would allow the building to be moved at
least 13 feet from its proposed location to allow a set back of 25 feet from the
front line, and be moved an additional 10 feet from its proposed location to allow
a 15 foot set back from the side line.
The Board herein denies the requested variance and makes the following recommenda-
tion:
Section 7, Part 1 of the by-laws of 1971 states:
If more than one building (other than a one, two, or three car garage, a tool shed,
a greenhouse, or a cabana) may lawfully be placed on any lot in a single or common
ownership, the distance between the nearest parts of such buildings shall be not
less than 20 feet."
I The Board finds that the proposed building be moved until it conforms to the front
yard depth and side line requirements, and in doing so will be no more than 20 feet
from the existing structure (the home) . Therefore the proposed storage garage will
be governed by Section 7 Part 1 of the zoning by-laws and mayrb'e constructed without
action by this Board.
Vote = Unanimous - •_- -- L°C/
FORM 1095 HOBBS B WARREN.
