.. THE COMMONWEALTH OF MASSACHUSETTS
TOWN OF MASHPEE
B®ARD OF APPEALS
-------March..15--••------------------------19.....72
Decision of the Board of Appeals on the appeal and petition of..............................................
Otis Trailer Village
............................................................................................................................................................
Hearing: February 16, 1972, S p.m. , Mashpee Town Hall
Board Members: Peter M. Lawrence
Clara Keliinui
Kevin D. O'Connell
Petitioner: Otis Trailer Village, Patricia R. and Malcolm E. Macdonald
The Board finds :
1. The area in which the petitioner asks to extend his non-conforming use is presently
zoned R-2 Resedential. It is the finding of the Board that to allow the extension
of the non-conforming use into a resedential area would constitute a change of zoning
of the area. Zoning changes by ammendment are governed by Section 13 of the Zoning
By-Laws of the Town of Mashpee, 1971, and require the insertion of an article in
the Town Meeting Warrant.
2. Mashpee Zoning By-laws dating from the early 60's have prohibited the use or
extablishment of trailers and trailer parks. The residents of the Town of Mashpee
have reaffirmed their desire to prevent the establishment of trailer or camping
facilities by voting against a proposal to allow camping facilities in the Santuit
Pond Area in 1970, and again by overwhelmingly accepting the current zoning laws of
1971, which clearly out-law the establishment of such facilities. The Board finds
that the issuance of a Special Permit to allow the extension of Otis Trailer Village
would not be in the best interests of the community.
3. The land on which the non-conforming use was to be extended was purchased by the
petitioner during the summer of 1971. Zoning laws of the town have since 1967
prohibited the establishment of trailer and camping facilities. The Board feels
that the petitioner was aware of the zoning laws of the town, concerning trailers', and
camping, and therefore purchased the property with these facts within his knowledge.
4. The Board submits herein a letter from Richard Staff, Counsel to the Town of
Mashpee. See attached letter.
5.
