TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Ret Petition of Jean P. Canning for a Special Permit <br /> A petition was filed by Jean P. Canning of Falmouth, Massachusetts <br /> for a Special Permit under Section 6.3 of the Land Use Regulations for <br /> permission to operate a Branch Bank on property located on Route 28, one- <br /> eighth of a mile south of the Mashpee Rotary, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 19?5. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on June 3, 1980, <br /> and June 10, 1980, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, June 18, 1980, at MO p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughouti Robert <br /> J. Houle, Peter L. Jangler, Raymond G. Sweeney. <br /> On a plan submitted to the Board, the Petitioner indicated the <br /> intension to construct a bank building, with a drive-up window. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> grant the request for a Special Permit to operate a bank, with a drive=up <br /> window. <br /> The Board found that the use of the premises would not be detrimental <br /> to the Town or area by reason of excessive traffic noise, or demand on <br /> community facilities. The Board also established that granting the Permit <br /> would be in the best interest of the community, and would be in harmony <br /> with the general purpose and intent of the ordance or by-law. <br />
