TOWN OF MASHPEE
BOARD OF APPEALS
DECISION
Re: Petition of Robert R. NcNutt for a Special Permit
A petition was filed by Robert R. McNutt of Mashpee, Massachusetts
.f for a Special Permit under Section 6.3 - A, of the land Use Regulations for
permission to construct condominiums, on property located on Falmouth Road
Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975•
Notice was given by publication by publishing in the Falmouth Enterprise,
a newspaper of general circulation in the Town of Mashpee on May 6, 1980
and May 16, 1980, a copy of which is attached hereto and made a part hereof.
A public hearing was held on the petition at the Mashpee Town Hall
on Wednesday, May 26, 1980 at 8:15 p.m. at which time the following members
of the Board of Appeals were present and acting throughout: Raymond G.
Sweeney, Peter L. Langler, Peter Muse.
The Petitioner presented a plan to the Board and indicated the
intensions of the area, number of units, parking facilities, amenities, and
access road.
Upon motion duly made and seconded the Board voted unanimously
to grant the request for a Special Permit as requested.
The Board found that the use of the premises would not be detrimental
to the Town or area by reason of excessive traffic noise, or demand on
community facilities. The Board also established that granting the Permit
would be in the best interest of the community, and would be in harmony
with the general purpose and intent of the ordance or by-law.
