Gessner, Trustee for a Special Permit <br /> Case #SP-4-007 <br /> A petition was filed by Gilmore G. Gessner of Falmouth, <br /> Massachusetts for a SPECIAL PERMIT under Section 9.37, Sections <br /> 9.31. 9.321 and 9.322, for permission to construct thirty (30) <br /> two-bedroom condominium units on property located off Route 28, <br /> at Wags Road (Falmouth side of Rotary) Map 81, part of parcel #1, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A. Notice was also given <br /> by publishing in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on April 13, 1982 and April 20, <br /> 1982, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town'Hall on'Wedneaday' April 28; 1982 at ,7:30' p.m. and. continued <br /> 4 <br /> on Wednesday, May 5, 1982 at 7130 p.m., at which time the following <br /> members of the Board were present and acting throughouti Michael <br /> Makunas, Peter Muse, Peter Lawrence. <br /> The presentation of the application was made by Mr. Gilmore <br /> Gessner. Mr. Gessner explained that June 4, 1981, a variance <br /> had been granted by the Board, and after the litigation with the <br /> Planning Board was resolved, the revised decision was filed with the <br /> court. The only changes from the variance petition is the reduction <br /> of the sixty-eight units. <br />
