TOWN OF MASHPEE
Board of Appeals
Town Hall, Mashpee, Massachusetts 02649
REVISED DECISION
Re: Petition of Gilmore G. Gessner for a Variance Case #V-81-4-011
A Petition was filed by Gilmore G. Gessner of Falmouth, Massa-
chusetts for a Variance under Section 9. 31, 9. 321 and 9. 322 for permission
to construct sixty-eight (68) condominium units on property located off
Route 28, at Wags Road (Falmouth side of Rotary) Map 81, part of parcel
#1, Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws, Chapter 40A. Notice was given by publication in the
Falmouth Enterprise, a newspaper of general circulation in the Town of
Mashpee, on March 31, 1981 and April 7, 1981, a copy of which is attached
hereto and made a part hereof.
r
A public hearing was held on the petition at the Mashpee Town Hall
on Wednesday, April 15, 1981, at 8:00 p. m. at which time the following
members of the Board of Appeals were present and acting throughout:
Robert J. Houle, Chairman, Michael Makunas, John Slavinsky.
The Petitioner made the presentation to the Board, explaining the
request for a variance to construct sixty-eight (68) multi-family dwellings
in an R-3 Zoning District. Indicating on various renderings presented to
the Board, the Petitioner felt that the proposal would be more advantageous
to the Town than single-family dwellings.
The Board found that the Petitioner established, to the satisfaction
of the Board, a hardship unique to the particular property.
