TOWN OF MASHPEE ' <br /> BOARD OF APPEALS <br /> 5 TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> WE DECISION <br /> Petition of Alan Industries, Inc. for Special Permit Case <br /> {SSP-84-10-048 <br /> Finding of Facts <br /> The Mashpee Board of Appeals held a hearing on November 7, <br /> 1984 on the application for a Special Permit for Alan Industries, <br /> Inc. to use premises situated at the Rotary Circle and Great Neck <br /> Road situated in a C-1 district for the conduct of a service <br /> business for the sale, service, rental and storage of audio/visual <br /> equipment and also the storage of a satellite dish. The stated <br /> purpose on the application for Special Permit indicated that the <br /> Petitioner sought to modify his present permit to allow for <br /> " (more detail (sic. ) , use and sales) ". <br /> A copy of the application for the Special Permit is annexed <br /> to this decision and incorporated by reference herein. <br /> The application was received by the Board October 5, 1984. <br /> Notice of the hearing was published in the Falmouth Enterprise on <br /> October 24, 1984 and .October 31 , 1984. The application for Special <br /> Permit was filed with the Town Clerk on October 29, 1984. Notice <br /> was duly given to abutters in accordance with the requirements of <br /> M.G. L. Chapter 40A. <br /> Board Members present and voting on this application were <br /> Michael Makunas, William Hanrahan, and Peter Muse. <br /> Alan Mendleson appeared on behalf of Alan Industries, Inc. . <br /> He indicated to the Board that he felt a mistake had occurred in <br /> an earlier hearing for Special Permit. He indicated to the Board <br /> that its , decision on the prior petition for Special Permit, (being <br /> SP-83-8-029 decided February 1 , 1984) , took away from him the <br /> power to sell at retail his audio/visual equipment and that he did <br /> not intend this to happen. He indicated that he wanted to have <br /> the ability to sell at retail, and rent, consumer electronics. He <br /> presented to the Board a booklet entitled "Panasonic" consisting <br /> of what appeared to be a catalog of Panasonic products containing <br /> 155 pages of various pieces of electronic equipment. <br />
