Wasil for a Special Permit Case <br /> #SP-84-3-01 <br /> FACTS <br /> A Petition was filed by Edward R. Wasil of Mashpee, <br /> Massachusetts for a Special Permit for permission to operate <br /> a Flea Market on property located on Route 28, Mashpee, <br /> Massachusetts, pursuant to Section 6. 3.F.9 of the Zoning <br /> By-Law. Locus is in a C-1 Zone. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in the Falmouth Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on March 6, 1984 <br /> and March 13, 1984 a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, March 21, 1984 at 7:30 p.m. at which <br /> time the following members of the Board of Appeals were present <br /> and acting throughout: Michael Makunas, Manuel Costa and <br /> Virginia Landry. <br /> Mr. Ray Sweeney attorney for the Wasil, s explained that <br /> they seek a special permit to operate said flea market due to <br /> an amendment of zoning by-laws. Mr. Wasil has operated the <br /> flea market in town for a number, of years. <br /> The Board noted that a serious traffic problem existed <br /> on Saturday and Sunday, with cars frequently parking on Route <br /> 28, It was further noted by the Board that prior usage of the <br /> premises included sleeping overnight in campers and trailers <br /> by transient vendors and other presumed sellers of merchandise <br /> at the flea market. <br /> Mr. Sweeney assured the Board that the applicant would <br /> comply with all requirements imposed by the Board and would <br /> cause landscaping to be done in accordance with the recommenda- <br /> tions of the Design Review Committee and the requirements of <br /> the Board. <br />
