TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> . . TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> P DECISION <br /> AB <br /> RE: Petition of P.F. O'Connor for Variance Case #V-86-02-013 <br /> A petition was filed by P. F. O'Connor for a Variance for permission to <br /> vary the parking requirements in a C-2 and I1 zoning district on property <br /> located on Route 130, Assessor's Map 19 Parcel 10, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on January 29, 1986 <br /> and February 5, 1986 a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, February 12, 1986 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Manuel Costa and Cheryl Hawver. <br /> Attorney Chris Clark represented P.F. O'Connor in this matter. He provided <br /> the Board with a detailed traffic study on other operations of the company. <br /> Upon motion duly made and seconded the Board voted unanimously to grant <br /> the variance to allow 52 parking spaces rather than the 99 spaces required. <br /> The Board also established that granting the variance would not be <br /> detrimental to the Town, and would be in harmony with the general purpose <br /> and intent of the ordinance or By-law. <br /> . It was the Board 's feeling that the parking requirements under the current <br /> zoning by-laws were excessive for this particular use and would create a <br /> hardship if the requirements were imposed. <br />
