TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> 1.98 CA DECISION <br /> RE: Petition of Sandpiper Village Trust for a Variance Case <br /> #V-87-01-002 <br /> A Petition was filed by Sandpiper Village Trust of <br /> Mashpee, Massachusetts for a Variance for permission to <br /> vary the parking requirements in a R-4 Zoning District on <br /> property located on Lot 3 Ryans Way, (off Central Road), <br /> Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in the Falmouth Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on December 31, <br /> 1986 and January 7, 1987, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, January 14, 1987 at 7 :30 p.m. at <br /> which time the following members of the Board of Appeals <br /> were present and acting throughout : William Hanrahan, Michael <br /> Makunas and Cheryl Hawver. <br /> The Applicant, through his counsel, advised the Board <br /> that the Planning Board had granted a Special Permit pursuant <br /> to section 9 . 3 et seq. of the By-Laws to develop a twenty-six' <br /> (26) unit open space multi-family development on the condition <br /> that the Applicant seek a variance from the Board of Appeals <br /> from the provisions of section 8. 6 of the By-Law. The appli- <br /> cant submitted a letter from the Planning Board addressed to <br /> the Appeals Board endorsing the development concept and re- <br /> commending favorable action on the variance request . <br /> The issue raised by this application is whether the pro- <br /> posed parking for the complex is located to the rear and side <br />
