COMMONWEALTH OF MASSACHUSETTS <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> CERTIFICATE OF COMPLIANCE <br /> This matter was brought before the Board of Appeals of the <br /> Town of Mashpee at a duly advertised Public Meeting on <br /> September 28, 1988, pursuant to Paragraph 30 of a "Decision of <br /> the Board of Appeals on Petition to Modify Special Permit" <br /> ( "Decision" herein) dated January 29 , 1985, which Decision <br /> modified Special Permit dated March 5, 1974, and which Decision <br /> permitted the issuance of a Special Permit to construct a planned <br /> retirement community in accordance with Master Site Development <br /> Plan referenced in said Decision. Said Paragraph 30 of the <br /> Decision requires the Applicant to file with the Zoning Board of <br /> Appeals for its approval, a copy of the Final Site Development <br /> Plan for each phase to be constructed. <br /> There was at said meeting presented to the Board a Final <br /> Site Development Plan for Phase II , which said._plan. is* entitled: <br /> Preliminary for Phase II Southport ( formerly Pine Hills <br /> Estates) , Mashpee, Massachusetts, which said plan is dated <br /> August 11, 1988 ( "Final Site Development Plan" herein) . Said <br /> plan was prepared by E.J. Flynn Engineers, Inc . Said plan was <br /> amended by revision sketch dated September 28, 1988, which <br /> revisions was incorporated in the Final Site Development Plan. <br /> Prior to consideration of said plan, Applicant requested a <br /> Modification of the Special Permit to permit the alteration of <br /> Phase lines, with the result that Phase II would include portions <br /> or all of the original Phases III and IV, is shown on the Master <br /> Site Development Plan approved January 29, 1985 . The Board voted <br /> to permit said Modification. <br /> After duly advertised public hearing, and discussion of said <br /> plan with Michael A. Dunning, Attorney for Applicant, <br /> Mr. Fitzgerald, of E.J. Flynn; Engineering, Inc . , and Walter <br /> Yarosh, Architect, the Board of Appeals, in accordance with <br /> Paragraph 30 of said Decision, approves said Final Site <br /> Development Plan, and forwards its endorsement thereof to the <br /> Planning Board with its full recommendation. <br /> Where the Final Site Development Plan for Phase II, as <br /> approved by the Board of Appeals, differs from the Master Site <br /> Development Plan and the Decision referenced above, the said <br /> Final Site Development Plan referred to above shall govern. <br />
