MA 02649 <br /> DECISION <br /> RE: Petition of Donald Shapiro for a Variance Case #V-88-01-01 <br /> (owner on record; Donald Shapiro) <br /> A Petition was filed by Donald Shapiro of Mashpee, Massachusetts for <br /> a Variance for permission to construct a pool within 50 feet of the wetlands <br /> and for permission to enter within 25 feet of the A.C.E.C. district in a R-3 <br /> Zoning District on property located on lot 4 Tide Run, Little Neck Bay, <br /> Mashpee, Massachusetts, (map 126, parcel 42). <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> December 30, 1987 and January 6, 1988, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, January 13, 1988 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Michael Makunas and Edward Govoni . <br /> Mr. Cameron, Engineer representing the Applicant, informed the Board <br /> that hay bales surrounding the work limit would protect the wetlands from <br /> any adverse effect on the environment. Recommendations were received from <br /> the Mashpee Conservation Commission. <br />
