MA 02649 <br /> DECISION <br /> RE: Petition of Marilyn and Barnett Berliner for a Variance Case #V-88-01-05 <br /> (owner on record; Marilyn and Barnett Berliner) <br /> A Petition was filed by Marilyn and Barnett Berliner of Mashpee, <br /> Massachusetts for a Variance for permission to vary the lot size requirements <br /> in a R-5 Zoning District on property located on Sturgis Landing, (map 20, <br /> parcels 39 & 40) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper. of general circulation in the Town of Mashpee on <br /> December 30, 1987 and January 6, 1988, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, January 13, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: William <br /> Hanrahan, Michael Makunas and Edward Govoni . <br /> The Board was informed that the subdivision met approval from the <br /> Planning Board in 1985. Counsel , representing the Applicant, informed the <br /> Board that the petitioner proposes to remove the dwelling on lot 8, convert <br /> the dwelling on lot 9 into a boathouse and construct a new dwelling, which <br /> would straddle the lot line between the two lots, thereby removing the <br /> possibility of the lots reverting to two buildable lots. The Board ascer- <br /> tained that adequate frontage will be maintained on the private way as <br /> shown on plan,' as required in the provisions of the Massachusetts General <br /> Laws Chapter 41 , subsection 81 (0). <br />
