MA 02649 <br /> BOARD OF APPEALS <br /> F DECISION <br /> FOR A SPECIAL PERMIT <br /> I <br /> RE: Petition of John Morgan for a Special Permit Case: SP-88-11-108 <br /> A Petition.was filed by John Morgan of Centerville, Massachusetts <br /> for permission to construct a stairway and fixed pier in an R-5 zoning <br /> district on property located at 111 River Road (Map 89, Lot 3) Mashpee, <br /> Massachusetts (Owners of Record: Wm. Van Herwade and John L. Morgan) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice wasgivenby publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> December 28, 1988 and January 4, 1989. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, January 11, 1989 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William J. Hanrahan, Cheryl A. Hawver and Michael A. Makunas. The <br /> hearing was continued on March 22, 1989. <br /> George Thorng of Arrow Engineering present plans for a fixed pier <br /> 8' x 30' . Abutters present expressed concerns about the size and construction <br /> methods for the pier. Mr. Morgan agreed to revise plans to reduce the <br /> size of the pier. <br /> The revised plans were presented on March 22, 1989. The fixed <br /> pier has been replaced with a 6' x 12' float and sonar tubes have been <br /> replaced with treated wood posts on the bank. A letter was received <br /> from the Mashpee River Woodlands Committee approving the revised plan. <br /> The Shellfish Commission and Conservation Commission had no objections. <br /> 1- <br />
