MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: Petition of Eliot Levy for a Special Permit SP-89-07-76 <br /> A Petition was filed by Eliot Levy of Brookline, Massachusetts <br /> for A Special Permit to extend a non-conforming use with the addition <br /> of a single garage on property located at 120 Summersea Road <br /> (Map 105, Block 52) Mashpee, Massachusetts.in an R-3 zoning district. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 7 and August 14, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, August 23, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and William J. <br /> Hanrahan. <br /> Jeff Gainsborg, builder, represented the applicant. He presented <br /> plans for a single garage which would replace sheds on the property. <br /> The Board requested revised plans showing set-backs and lot coverage <br /> and these were prepared for the Board. <br /> The Board determined that the use is in harmony with other <br /> permitted uses in this zoning district and a change or extension <br /> would not be substantially more detrimental than the existing <br /> condition. The Board established that granting this Special Permit <br /> would be in harmony with the general purpose and intent of the <br /> by-laws and would not be a detriment to the neighborhood. <br />
