SECTION 118: GROUNDWATER PROTECTION DISTRICT <br /> 1 . AUTHORITY <br /> This by-law is adopted by the Town of Mashpee under its home <br /> rule powers, its police powers to protect the public health, <br /> safety and welfare, and under powers authorized by Mass. Gen. <br /> Laws, Ch. 41A, as amended. <br /> 2. PURPOSES <br /> The purposes of this by-law are to protect public health from <br /> the contamination of existing and potential public and private <br /> water supplies and to protect the general welfare by preserv- <br /> ing limited water supplies for present and future use. <br /> 3. DEFINITIONS <br /> 3.1 'Animal feedlot' means a plot of land on which twenty- <br /> five or more livestock per acre are kept for the purposes <br /> of feeding. <br /> 3.2 'Aquifer' means a geologic formation, group of formations <br /> or part of a formation which contains sufficient saturat- <br /> ed permeable material to yield significant quantities of <br /> potable groundwater to public or private wells. <br /> 3.3 'Disposal ' means the deposit, injection, dumping, spill- <br /> ing, leaking, incineration or placing of any hazardous <br /> material into or on any land or water so that such <br /> hazardous material or any constituent thereof may enter <br /> the environment or be emitted into the air or discharged <br /> into any waters, including groundwater. <br /> 3.4 'Groundwater' means all the water beneath the surface of <br /> the ground. <br /> 3.5 'Hazardous materials' means any substance or combination <br /> of any substances, not including any liquid petroleum <br /> product, that , because of quantity, concentration or <br /> physical , chemical or infectious characteristics, poses a <br /> significant present or potential hazard to water supplies <br /> or to human health if disposed of into or on any land or <br /> water in this Town. Any substance deemed a 'hazardous <br /> waste' in Mass. Gen. Laws, Ch. 21C shall also be deemed a <br /> hazardous material for purposes of this by-law. <br /> 3.6 'Impervious' means impenetrable by water. <br /> 3.7 'Leachable wastes' means waste materials, including solid <br /> wastes, sewerage , sludge and agricultural wastes, that <br /> are capable of releasing water-borne contaminants to the <br /> surrounding environment. <br /> 11-7 <br />
