(508) 540-6080 <br /> July 13, 1989 <br /> Board of Appeals <br /> Mashpee, Mass. <br /> Re: Application for Special Permit <br /> Peter and Maryanne Frongillo <br /> 42 Seconsett Island Road <br /> Mashpee, Mass. <br /> Enclosed is the completed Application for a Special Permit under <br /> Section 5. 1 of the Mashpee Zoning By-Laws. Four copies of this <br /> form and the accompanying Drawing # 528-5E-89 dated July 7, 1989 <br /> are enclosed . <br /> The existing home was built around 1970-71 under the then current <br /> R-100/R-125 zoning . A garden shed 11 '-1 " from the rear property <br /> line was built shortly thereafter . At that time required sideyard <br /> setback was 15 ft . , rear setback was 10 ft . . <br /> In 1988 the home was purchased by Peter and Maryanne Frongillo . <br /> The Frongillo 's would now like to build an 18 x 36 ft . in-ground <br /> swimming pool . This pool would be located in line with the <br /> existing shed . . . 11 '- 1 " from the rear property line. It will be <br /> located a minimum of 16 ft . from the side property line, thus <br /> meeting today's 15 ft . sideline setback requirements. <br /> We ask for The Board of Appeals to allow a Special Permit for the <br /> pool under Section 5. 1 of The Mashpee Zoning By-Law of 1987. <br /> The proposed pool will have the same rear setback line <br /> as the existing shed . <br /> It will not be, in any way, more detrimental than the <br /> existing non-conforming garden shed on the property or <br /> the adjacent neighboring structures set on the property <br /> lines themselves. <br /> Harry J.
