Frongillo for a Special Permit <br /> SP-89-07-76 <br /> A Petition was filed by Peter B. and Marianne S. Frongillo of <br /> Worcester, Massachusetts for a Special Permit to extend a non-conforming <br /> use to allow for the construction of a swimming pool in an R-3 zoning <br /> district on property located at 42 Seconsett Island Road (Map 119, <br /> Block 30) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 28 and September 4, 1989, a copy of which is attached hereto <br /> anI made a part hereof. <br /> A Public Hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, September 13, 1989 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Harry Corbett, Engineer, represented the applicant. He presented <br /> plans to the Board showing that the swimming pool would be built with <br /> a rear set-back of 11' 1" which is the same as an existing shed on the <br /> property.and a side line set-back of 161 . Comments were received from <br /> an abutter in favor of the petition. Comments were received from the <br /> Conservation Commission stating that they had no jurisdiction since <br /> the pool was more than 100' from the water. <br /> The Board determined that the use is in harmony with other permitted <br /> uses in this zoning district and a change or extension would not be <br /> substantially more detrimental than the existing condition. <br />
