BOX 1108 f MASHPEE, MA 02649 BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT RE: Application of Bernard Kelly for a Special Permit SP-89-07-79 A Petition was filed by Bernard Kelly of Mashpee, Massachusetts for a Special Permit to allow for a jewelry design studio workshop in an R-3 zoning district on property located at 609 Great Neck Road South (Map 104, Block 28) Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee, on August 28 and September 4, 1989, a copy of which is attached hereto and made a part hereof. A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, September 13, 1989 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. Mr. Kelly informed the Board that he was a jewelry designer and manufacturer and proposed to conduct business by appointment only. He planned to have a small sign on the premises. The Board of Health expressed concerns about the possible contamination of groundwater and suggested that Mr. Kelly obtain a V.S.Q.G. permit from the Massachusetts Department of Environmental Protection. On December 19, 1989 the Board. of Appeals received a memo from the Board of Health stating the the application for the V.S.Q.G. license and a satisfactory water sample had been received and the Board of Health had no objections. The Board received a letter from two abutters objecting to any commercial uses in a residential area and expressing concern on the impact a business establishment would have on traffic on Great Neck Road South.
