BOX 1108 <br /> rA8 MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Hamurco Associates for a Variance V-89-06-65 <br /> 135 Sunset Strip (formerly Lot 55) Map 46 Block 4 <br /> A Petition was filed by Hamurco Associates of Holliston, <br /> Massachusetts for a Variance for permission to vary the lot size <br /> and frontage requirements in an R-5 zoning district on property <br /> located at 135 Sunset Strip (Map 46, Block 4) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with the <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on July 24 and July 31, 1989, <br /> a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, August 9, 1989 at 7:30 p.m, at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Richard E. Halpern and John J. Friel. <br /> Attorney Richard Anderson represented the applicant. He <br /> explained that a variance had been granted on this lot on <br /> December 10, 1986 and a six-month extension of the variance had <br /> been granted on February 11, 1988. The variance has now expired <br /> and Town Counsel had determined that a new hearing was necessary. <br /> The Board was informed that the lot is one of six Hamurco lots <br /> upon which construction had not commenced. The lot is shown on an <br /> approved subdivision plan. Due to the limitations as to the number <br /> of building permits that could be issued, the rights authorized by <br /> the earlier variance could not be exercised. <br />
