BOARD OF APPEALS <br />• MINUTES <br />August 17, 1988 <br />At 7:30 p.m, on Wednesday, August 17, 1988 the Board of Appeals held <br />a meeting at the Mashpee.Town Hall. Board members present and acting <br />throughout were: William Hanrahan, Richard Halpern, Michael Makunas <br />and Edward Govoni. <br />JOHN MALLOY - Requests a Special Permit under Section 6.I.9 of the <br />Land Use Requirements for permission to construct and maintain a <br />walkway, pier, ramp, float and dock facility in an R-3 zoning district <br />on property located at Lot 166, Whipporwill Circle (Map 125, Lot 151) <br />Mashpee, MA pursuant to an application and an appeal to the Barnstable <br />Superior Court (Civil Action No. 87-593) was taken therefrom. Subsequently, <br />such application was remanded to the Board of Appeals by the Barnstable <br />Superior Court for the purposes of reopening the Public Hearing on this <br />matter. <br />Members sitting: W. Hanrahan, M. Makunas,,R. Halpern <br />Mr. Halpern read a letter from P. C. Toomey, Attorney for Mr. Malloy, <br />requesting that the hearing be postponed until September 14, 1988. <br />Mr. Halpern moved to continue the hearing to September 14, 1988. <br />Mr. Makunas seconded. All agreed. <br />• BONWOOD CO. INC. - (Owner of record: Reliance Development Corp.) <br />Applicant seeks to modify Special Permit Decision, originally issued <br />April 10, 1974 and modified January 29, 1985, as follows: that paragraph <br />11 of said "Decision to Modify Special Permit" be modified to that the <br />location of the buffer zone referred to therein be as shown on plan <br />entitled "Southport of Cape Cod Perimeter Setback Plan" by E. J. Flynn <br />Engineers, Inc. filed herewith, said property bounded south by Route 151, <br />east by Algonquin Avenue, north by John's Pond and lots on Falmouth Road <br />being Lots 35 and 35A on Map 65 (Map 65, Lot 35) Mashpee, MA. <br />Members sitting: W. Hanrahan, M. Makunas, E. Govoni <br />Attorney Michael Dunning represented the petition. Ron Bonvey of the <br />Bonwood Co. and Shannon Murphy of Yaroush Associates were also present. <br />Attorney Dunning explained that Bonwood Co. is seeking a modification of <br />Section 11 of the Special Permit concerning the buffer zones of the <br />project. He explained that the architects considered a reduction of <br />the size of the buffer zone in some areas would be beneficial. <br />Mr. Bonvey reviewed the plans of the final site development plan with <br />abutters present. <br />Mr. Makunas moved to grant the change in buffer zones as shown on plan <br />of E. J. Flynn "Southport of Cape Cod Perimeter Setback Plan". Mr. Govoni <br />seconded. All agreed. <br />
