MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: Norma Atkinson for a Special Permit SP-90-55 <br /> A Petition was filed by Norma Atkinson of Hyannis, Massachusetts <br /> for a Special Permit under Sections 174-25.B. 14 and 174-25.E.2 of the <br /> Zoning By-laws for permission to operate a public club for entertainment <br /> and dancing and to serve sandwiches and non-alcoholic beverages in a <br /> C-2 zoning district on property located at 470 Main St. (formerly <br /> Ma Glockner's Restaurant) (Map 27, Block 21) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on July 9 and July 16, 1990, a copy of which is attached and made a <br /> part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 25, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, William J. Hanrahan and John J. Friel. <br /> Nicholas Tenaglia represented the applicant and explained that <br /> the purpose of the club was to give people who did not drink a place <br /> to go for entertainment. He stated that they were planning to operate <br /> Friday and Saturday evenings and possibly Sunday afternoon. <br /> Comments in opposition to the Petition were received from <br /> neighbors who expressed concern about the noise and traffic which <br /> might result. The Building Inspector stated that the lot is zoned <br /> for commercial use and residents were aware of the zoning since a <br /> restaurant had been operational at the site. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the zoning By-laws and complies with the <br /> provisions thereof. <br />
