MA 02649 <br /> BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: Petition of Pamela Peters for a Special Permit SP-90-49 <br /> A Petition was filed by Pamela Peters of Falmouth, Massachusetts <br /> for a ;Special Permit under Section 174-25.D. 1 of the Zoning By-laws <br /> for permission to operate a real estate office in a C-2 zoning <br /> district on property located at 401 Nathan Ellis Highway and <br /> 34 Sassacus Road (Map 72, Blocks 57 and 58) Mashpee, Massachusetts. <br /> (Owner of record: Alexander and Ecaterini Mitrokostas) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on June 25 and July 2, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 11, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, William J. Hanrahan and John J. Friel. <br /> Pamela Peters represented the Petition. She explained that she <br /> was opening a real estate office at the site with planned square <br /> footage in excess of 1,000 square feet. Comments were received from <br /> Constantinos Mitrokostas, the owner of the property, that the number <br /> of parking spaces exceeded the by-law requirements. Health Agent <br /> Elias McQuaid stated that the Board of Health had no objections to total <br /> occupancies of the retail space,.by not more than twenty-four employees. <br /> The Board determined that the Petitioner met the conditions <br /> necessary for the granting of a Special Permit. The Board found <br /> that the use is in harmony with the general purpose and intent of <br /> the Zoning By-laws and complies with the provisions thereof. <br />
