MEMORANDUM OF AGREEMENT <br /> The Town of Mashpee, through its Board of Selectmen and the Massachusetts Laborers' District Council, <br /> Mashpee Public Employees' Local Union of the Laborers' International Union of North America(LIUNA), <br /> agree that Section 5, Part A and Part B of the Agreement between the Town of Mashpee, Maurice A. <br /> Cooper and the Massachusetts Laborers'District Council,Mashpee Public Employees' Local Union of the <br /> LIUNA,dated July 1, 1995 to June 30, 1998,is amended and replaced as follows: <br /> 5. Educational Incentive <br /> a. The Employee as qualified for educational incentives under Chapter 41 Section 1081, of <br /> the Massachusetts General Laws,also(mown as the Quinn Bill shall receive that benefit <br /> as outlined in Massachusetts General Law Chapter 41 Section 1081, and for retirement <br /> purposes. <br /> b. In the event the Commonwealth of Massachusetts fails to pay any portion of its share of <br /> the Quinn Bill, the Town shall be liable for no more than its fifty percent (50%) share, <br /> but shall remit to the employee whatever amount is received from the Commonwealth for <br /> the Quinn Bill. <br /> C. The base salary of the employee for the purposes of calculating his base salary increase <br /> under M.G.L.,Chapter 41 Section 1081, shall be his base salary as set forth in Appendix <br /> "A" of the Wage Compensation Plan for Unit A, effective July 1, 1997 as contained in <br /> the Agreement Between The Town of Mashpee and the Massachusetts Laborers' District <br /> Council in behalf of Mashpee Public Employees' Local Union of the LRJNA July 1, <br /> 1995—June 30, 1998 and continuing with any new wage appendix contained in successor <br /> agreements. <br /> d. The Base salary increase granted under MGL Chapter 41 Section 1081, will be paid in <br /> the first pay period in December and in the first pay period in June in each fiscal year. If <br /> the employee leaves the employ of the Town prior to any such payment due date,he shall <br /> be paid at the time of the termination of employment his pro rata share of the payment he <br /> would have received on the payment date. <br /> e. All of the provisions of his educational incentive agreement as herein contained shall take <br /> effect on June 30, 1998, and remain in effect during the successor agreement to <br /> commence July 1, 1998. <br /> In witness whereof,the Board of Selectmen of the Town of Mashpee has caused this change in the <br /> Agreement between the Town of Mashpee, Maurice Cooper, and the Massachusetts Laborers' <br /> District Council in behalf of Mashpee Public Employees' Local Union of the LIUNA to be signed <br /> and executed and duly attested by its Town Clerk, the employee and the Laborers' Union being <br /> signed and executing this Agreement on , 1998. <br /> Town of Mashpee <br /> Board of Selectmen <br /> Ma1W Vroiiper, Jr. <br /> hpee Public Employees Union <br /> 4LaWDiscltaCouncil <br /> Town Clerk <br />
