Stay within one hundred and fifty (150) feet of the afaresaid flag and float, or tow the float with him while he is submerged and surface thereunder, unless for special purposes permission is granted in writing by the Harbormaster to otherwise display flags for the protection of divers. Section VII r Enforcement and Penalties. A. Unless otherwise specified, the provisions of this by-law shall be enforced by the Harbormaster, by Assistant Harbormaster and by police officers empower- ed to patrol the waters of the Town of :,Mashpee. B. hhoever violates any of the provisions of the by-law and refuses to obey the lawful and reasonable orders of those empowered to enforce same, or resists them in the discharge of their duties shall be fined not less than ten (10.00) dollars nor more then fifty (50.00) dollars for the first violation and not less than twenty-five (25.00) dollars nor more than fifty (50.00) dollars for repeated violations. Section VIII - Jurisdiction, Nothing contained herein shall be held or construed to supercede or conflict with or interfere with or limit jurisdiction of the United States Government with respect to the enforecment of the navigation, shipping, anchorage and associated laws of the United States, or any lawful regulation of the Division of Waterways of the Department of Public Works, or to the Division of Motorboats of the Registry of Motor Vehicles, or to conflict with any laws of the Commonwealth of Massachusetts. To see if the Town will vote to add the following by-laws relative to inland waterways within the Town: Section I. Speed regulation - No person shall operate a motor boat, as defined in Chapter 90B of the Massachuestte General Laws on the ponds.of Mashpee within one hundred fifty (150) feet of shore at a rate of speed in excess of six (6) miles per hour or in all areas during the period from one hour after sunset to one hour before sunrise at a rate of speed in excess of six (6) per hour. Section 2. Water Skiing - No person shall water ski, except to start and stop, on all ponds within Mashpee, within one hundred fifty (150) feet of any shore. No person shall operate a motor boat while drawing more than two water skiers at thesame time. No person shall water ski on John's Pond, Santuit Pond, Ashumet Pond -and Mashpee-Wakeby Pond except during the hours of one hour after sunrise and one hour before sunset. Section 3. Age of Motorboat Operator - No child under fifteen (15) years of age shall operate, nor shall the owner of a boat permit such operation of a motor rated at ten (10) hoursepower or more, without the presence of a responsible adult capable of operating a motor boat. Section 4. Penalties for Violations - Whoever violates any of the provisions of these regulations relative to the use of waterways shall be punished.by a fine of not more thab fifty ($50.00) dollars except as provided in Section 14 if Chapter 90B of the Massachusetts General Laws relative to first offenders. .,!;`.Section 5. The Board of Selectmen may appoint a Harbormaster with police powers for each of the ponds within the Town to enforce the by-laws relative to use of waterways. One Harbormaster may act as such for more than one pond. Section 6. Signs - The Park and hecreation Commission shall cause Section 1 through Section 4 to be posted at all public land- ings on the four ponds within the Town." To see if the Town will vote to raise and appropriate or take from available funds the sum of $4,800.00 to be used for oiling 300 feet of road, building a cement launching pad 12 feet
