Special Town Meeting <br />July 12, 1972 243 <br />-4- <br />3. Stay within one hundred and fifty (150) feet of the afaresaid <br />flag and float, or tow the float with him while he is submerged and <br />surface thereunder, unless for special purposes permission is granted <br />in writing by the Harbormaster to otherwise display flags for the <br />protection of divers. <br />Section VII r Enforcement and Penalties. A. Unless otherwise <br />specified, the provisions of this by-law shall be enforced by the <br />Harbormaster, by Assistant Harbormaster and by police officers empower- <br />ed to patrol the waters of the Town of :,Mashpee. <br />B. hhoever violates any of the provisions of the by-law and <br />refuses to obey the lawful and reasonable orders of those empowered <br />to enforce same, or resists them in the discharge of their duties shall <br />be fined not less than ten (10.00) dollars nor more then fifty (50.00) <br />dollars for the first violation and not less than twenty-five (25.00) <br />dollars nor more than fifty (50.00) dollars for repeated violations. <br />Section VIII - Jurisdiction, Nothing contained herein shall <br />be held or construed to supercede or conflict with or interfere <br />with or limit jurisdiction of the United States Government with <br />respect to the enforecment of the navigation, shipping, anchorage <br />and associated laws of the United States, or any lawful regulation <br />of the Division of Waterways of the Department of Public Works, or <br />to the Division of Motorboats of the Registry of Motor Vehicles, or <br />to conflict with any laws of the Commonwealth of Massachusetts. <br />Section Ik - In the event that any provision, section on <br />cause of this by-law. <br />Action: Motion duly made and seconded to accept the article <br />as read. A.unanimous vote. <br />Article 18. To see if the Town will vote to add the following <br />by-laws relative to inland waterways within the Town: <br />Section I. Speed regulation - No person shall operate a motor <br />boat, as defined in Chapter 90B of the Massachuestte General Laws <br />on the ponds.of Mashpee within one hundred fifty (150) feet of <br />shore at a rate of speed in excess of six (6) miles per hour or <br />in all areas during the period from one hour after sunset to one <br />hour before sunrise at a rate of speed in excess of six (6) per <br />hour. <br />Section 2. Water Skiing - No person shall water ski, except to <br />start and stop, on all ponds within Mashpee, within one hundred <br />fifty (150) feet of any shore. No person shall operate a motor <br />boat while drawing more than two water skiers at thesame time. No <br />person shall water ski on John's Pond, Santuit Pond, Ashumet <br />Pond -and Mashpee-Wakeby Pond except during the hours of one hour <br />after sunrise and one hour before sunset. <br />Section 3. Age of Motorboat Operator - No child under fifteen <br />(15) years of age shall operate, nor shall the owner of a boat <br />permit such operation of a motor rated at ten (10) hoursepower or <br />more, without the presence of a responsible adult capable of <br />operating a motor boat. <br />Section 4. Penalties for Violations - Whoever violates any of <br />the provisions of these regulations relative to the use of waterways <br />shall be punished.by a fine of not more thab fifty ($50.00) dollars <br />except as provided in Section 14 if Chapter 90B of the Massachusetts <br />General Laws relative to first offenders. <br />.,!;`.Section 5. The Board of Selectmen may appoint a Harbormaster <br />with police powers for each of the ponds within the Town to enforce <br />the by-laws relative to use of waterways. One Harbormaster may act <br />as such for more than one pond. <br />Section 6. Signs - The Park and hecreation Commission shall <br />cause Section 1 through Section 4 to be posted at all public land- <br />ings on the four ponds within the Town." <br />Action: Motion made and seconded that article be accepted as <br />read. A unanimous vote. <br />Article 19. To see if the Town will vote to raise and appropriate <br />or take from available funds the sum of $4,800.00 to be used for <br />oiling 300 feet of road, building a cement launching pad 12 feet <br />
