103rd. ANNUAL TOWN MEETING :'ARRANT <br />ARTICLE 30 {contd} <br />ACTION: Motion made and seconded that article 30 be amended to read: <br />To see if the Town will vote to authorize the Highway Dept. to hire <br />two full time skilled laborers to work for the Highway Dept. the <br />salary to be left to the discretion of the Personnel Board in <br />accordance with Section 7C of the Salary Administration, plan..Motion <br />made and seconded to accept Article 30 as amended. So Voted. <br />ARTICLE 31. To see if the Town will vote to raise and appropriate <br />or take from available funds the sum of $13,748.15 to be used for <br />Highway Maintenance under Chapter 497, Section 14. These monies to <br />be completely reimbursed by the State Grant or take any other action <br />thereon. Submitted by Highway Dept. <br />ACTION: Motion made and seconded that Article 31 be amended to read: <br />To see if the Town will vote to take from available funds the sum of <br />$13,74$.15 to be used for Highway Maintenance under Chapter 497, <br />Section 14. These monies to be completely reimbursed by the State <br />Grant or take any other action thereon. Submitted by Highway Depart- <br />ment. So Voted. <br />ARTICLE 32. To see if the Town will vote to raise and appropriate or <br />take from available funds the sum of $1,500 which may be used for <br />Highway Maintenance under Capter 90, representing the Town's share <br />and to transfer from available funds in the Treasury, the sum of <br />$3,000, representing the State and County this amount when reimbursed, <br />to be returned to surplus revenue, or take any other action thereon. <br />Submitted by,Highway Department. <br />r <br />ACTION: Motion made and seconded to raise and appropriate $1,500. <br />Unanimously voted. <br />ARTICLE 33. :To see if the Town will vote to approve the following <br />bylaws or take any other action thereon. <br />1.-1 AUTHORITY <br />This by-law prescribes certain powers and duties of the Highway <br />Surveyor. He is authorized to issue permits for work to be performed <br />upon any Town Highways or section thereof. <br />In this connection attention is directed to the "Town of Mashpee <br />By-laws" effecting Town Highways which provides as follows: <br />"Digging up Town Highways; Bond; Permit. No Town Highway shall be <br />dug up, or opening made therein for any purpose, nor shall any material <br />be dumped or placed thereon or removed or construction or structure <br />placed thereon or removed therefrom or changed without the written <br />permit of the Highway Surveyor, and the work shall be done under its <br />supervision and to its satisfaction, and the entire expense of replac- <br />ing and resurfacing the highway at the same level and in as good <br />condition as beford, with material equal in specifications to those <br />removed, shall be paid by the persons to whom the permit was given <br />or by whom the work was done. The department may require a bond to <br />guarantee the faithful and satisfactory performance of the work and <br />payment for any damage to town highways and facilities caused by or <br />resulting from the operations authorized by such permit. The amount <br />of said bond shall be not less than one thousand dollars and not more <br />than fifty thousand dollars. Except as provided herein any person <br />who digs up or makes an opening in a town highway without a permit <br />' or violates any other provisions of the section shall be punished by <br />a fine of not more than fifty dollars for the first offense and not <br />less than fifty dollars nor more than one hundred dollars for any sub- <br />sequent offense." <br />ACTION: Motion made and seconded to amend Article 33 to read the <br />last sentence as follows: Except as provided herein any person who <br />digs up or makes an opening in a town highway without a permit or <br />violates any other provisions of the Section shall be punished by a <br />fine of not more than fifty dollars for each day for a continuing <br />offense.
