330 <br />Continued Page 13 May 12, 1975 <br />Article 58: To see if the Town will vote to transfer to the care and custody <br />of the Conservation Commission the Town Forest containing two hundred ten (210) <br />acres, being the same premises described in Article 28 of the 1972 Annual Town <br />Meeting, or take any other action thereon. <br />ACTION: Motion duly made and seconded to accept Article 58 as read. A <br />unanimous vote. <br />Article 59: To see if the Town will vote to amend the Town By -Laws by adding <br />an additional section to read asEfollows: "No land acquired by the Town through tax <br />title proceedings shall be sold or otherwise disposed of until it shall have first ' <br />been determined by a vot6 at a Town Meeting whether or not said land shall be <br />held by the Town as Conservation Land, with the custody and control thereof being <br />transferred to the Conservation Commission for all purposes included in Section 8C <br />of Chapter 40 of the General Laws as it now reads or may hereafter be amended, shall <br />be held by the Town for some other municipal purpose." <br />ACTION: Motion duly made and seconded to accept Article 59 as read. So voted. <br />Article 60: To see if the Town will <br />vote to delete Chapter III - <br />Article IV <br />of the Town By -Laws: Rules and <br />Regulations, <br />relative to the dredging or <br />filling of <br />waterways and marshlands within <br />the Town which <br />reads as follows: <br />Section 1. All applications for a permit to dredge or fill must conform with <br />State and Federal statutory rules or requirements with reference to navigable waters. <br />Section 2. All applications must be in writing or on a form prepared by the <br />Board of Selectmen and available at the office of the Town Clerk and shall be <br />accompanied by a filing fee of ten dollars. <br />Section 3. An application for a permit shall state: <br />a. The name and address(s) of the land affected. <br />b. The exact area sought to be dredged orfilled, identifying by landmarks or <br />monuments or by an accurate plan or survey of the land, marsh, or waterway affected. <br />Section 4. A public hearing shall be held on every application, which hearing ' <br />shall be advertised at least seven days before the date of the hearing. <br />Section 5. Any person violating the provisions of the By -Law shall be <br />punished by a fine not to exceed $20.00 for each offense. <br />ACTION: Motion duly made and seconded to accept Article 60 as read. So voted. <br />Article 61. To see if the Town will vote to add to and adopt the following <br />amendment to the Mashpee Conservation By -Law, the following: The Conservation <br />Commission may require the posting of a bond with surety, running to the municipality, anc <br />sufficient as to form and surety in the opinion of the Commissions' Counsel, to secure <br />faithful and satisfactory performance of work required by any final "Order of Conditions" <br />in such sum and upon such conditions as the Commission may require. Other evidence <br />of financial responsibility which is satisfactory to the Commission may be accepted <br />in lieu of bonding. Notwithstanding the above, the amount of such bond shall not <br />exceed the estimated cost of the work required or the restoration of affected lands <br />and property if the work is not performed as required, whichever is the greater. <br />Forfeiture of any such bond shall be recoverable at the suit of the municipality in <br />the Superior Court, or take any other action thereon. <br />ACTION: Motimn duly made and seconded to accept Article 61 as read. So voted. <br />Article 62. To see if the Town of Mashpee will vote to authorize the Town <br />by its Historical Commission to apply for and receive Federal, State and Private I Grants and accept donations from public or private sources for museum purposes, <br />with the approval of the Selectmen or take any other action thereon. <br />ACTION: Motion duly made and seconded to except Article 62 as read. So voted. <br />
