464 <br />Annual <br />Town Meeting <br />Article 14 continued <br />May 7, 1979 <br />The Selectmen shall,thereafter, hold a public hearing on the <br />Petition for Acceptance of the private way. Notice shall be <br />given of such hearing by publication in a newspaper of general <br />circulation in the Town at least seven days prior to the date <br />assigned for the hearing and said notice shall identify the pri- <br />vate way and also any connecting public or -private ways which are <br />deemed to be benefitted by the proposed acceptance. At this hear- <br />ing the Selectmen shall inform those in attendance of the total <br />estimated cost to be borne by the abutting property owners and <br />owners of property deemed to be benefitted by the acceptance and <br />improvements. <br />Upon receipt of the written approval of those property own- <br />ers bearing 50% or more of the estimated cost, the Selectmen <br />shall proceed to lay out the way and upon completion of the lay- <br />out shall cause an appropriate Article to be inserted in the next <br />Annual Town Meeting for action. Upon approval of said Article by <br />the voters at the Town Meeting, the proposed work to construct, <br />reconstruct or repair the private way, shall be put out to public <br />bid and within six months following the completion of the work, <br />the total cost -shall be apportioned by the Selectmen, with the <br />assistance of the Town Engineer and the Board of Assessors, to <br />the owners of the land abutting the way and to any other owners <br />of land deemed to be benefitted and betterments shall be assessed <br />to them in accordance with the provisions of the General Laws of <br />the Commonwealth. <br />The provisions of this by-law shall not be deemed in any way <br />to restrict the authority of the Board of Selectmen to initiate <br />action on their own to cause any private way to be accepted as a <br />public way. <br />ACTION: Motion made and seconded that Afticle 14 be accepted <br />as printed. Motion carried unanimously. <br />ARTICLE 15. To see if the Town will vote to transfer from the <br />Samuel G. Davis Trust Fund Account a sum of money to reduce the <br />principal payment for the Samuel G. Davis School, or take any <br />other action thereon. <br />ACTION: Motion made and seconded to see if the Town will <br />vote to transfer from the Samuel G. Davis Trust Fund Account the <br />sum of $6,000.00 to reduce the principal payment for the Samuel <br />G. Davis School. Motion carried. <br />ARTICLE 16. To see if the Town will vote to transfer the balance <br />of the Municipal Equipment Account to be applied to the Municipal <br />Equipment and Repairs Account; all expenditures to require the <br />joint approval of the Board of Selectmen and the Finance Committee, <br />or take any other action thereon. <br />ACTION: Motion made and seconded to see if the Town will <br />vote to transfer the balance of the Municipal Equipment Account in <br />the sum of $10,775.00 to be applied to the Municipal Equipment and <br />Repairs Account; all expenditures to require the joint approval of <br />the Board of Selectmen and the Finance Committee. Motion carried. <br />ARTICLE 17. To see if the Town will vote to transfer from avail- <br />able funds, or raise and appropriate, a sum of money to hire a <br />Recreational Director, or take any other action thereon. <br />ACTION: Motion made and seconded to see if the Town will <br />vote to raise and appropriate the sum of $10,845.28 to hire a <br />Recreational Director. Motion carried. <br />ARTICLE 18. To see if the Town will vote to transfer from avail- <br />able funds, or raise and appropriate, a sum of money as expenses <br />for the Recreational Program, or take any other action thereon. <br />ACTION: Motion made and seconded to see if the Town will <br />vote to raise and appropriate the sum of $2,000.00 as expenses <br />for the Recreational Program. Motion carried. <br />
