And then we had <br /> talked with the people who were doing the job and they were using Mylar stones or some- <br /> thing similar which renovated the need for the leakage holes because that allowed the <br /> passage of water and wouldn't allow it to build up in back, <br /> Barbara: Mr. O'Connor, are you an attorney? <br /> Mr. O'Connor: No, I am not. I've been a general contractor all of my life so I know a <br /> little bit about this stuff. <br /> Barbara: We could show you the Notice of Intent and their original plans submitted. <br /> Mr. O'Connor: If the plan is what they did, I have already made up my mind. We have re- <br /> tained a consultant to advise us. Lawrence Lynch said that they did it. In response to <br /> a set of specifications, they bid the job supposedly. <br /> Pauline: Shore Mr. O'Connor the Notice of Intent and a copy of the Order of Conditions. <br /> Barbara: Pauline, do you have letters asking for a Compliance? <br /> Pauline: The first one was 1979. They asked for it a year before and they have not com- <br /> plied with it. <br /> Mr. O'Connor: That's the point -- they didn't do the work. And they said now you people <br /> own it; now you pay for it. There is something in Massachusetts called Chapter 93A, the <br /> Consumer's Protection Act. <br /> Pauline: Would you care to sit down? <br /> Mr. O'Connor: Yes, I would. But tell met Did they submit a plan? <br /> Pauline: Oh, yes, they did. <br /> Barbara: Mr. Fred Williams from Lawrence Lynch came in and submitted plans. Charlie, do <br />, you remember we had them put in those weep hole things. <br />( Charles: Yes, we were talking of amending our Order of Conditions and decided not to press <br /> as long as there was no visible water lying on top. I was wondering how that looked after <br /> the last storms we have had. <br /> Mr. O'Connor: It is still there. But my personal opinion is that nothing will hold that <br /> banking back until they build a wall. <br /> Ken: Is this a repair? <br /> Pauline: No. This man, Mr. O'Connor, has purchased a condominium and now New Seabury is <br /> trying to make the fellows who purchased it pay for the work that was done prior to the <br /> purchase. <br /> Mr. O'Connor: The damage was done prior to the purchase. <br /> Barbara: I wondered how long they were going to get away with that. <br />
