-to- <br /> Dorothy: Not if a denial has been issued. <br /> Mr. Hennigan: The denial was issued subsequent to a request for a continuance based on <br /> DEQE's request to move the system from where it was originally. This is the plan. Be- <br /> cause it was near that lot line -- 10 feet. And I still think you can do it. <br /> Pauline: No. The denial was because the septic system was here and was within 40 feet <br /> of the marsh area. <br /> Mr. Hennigan: To begin with, it was not 40 feet. I am not going to argue that point. <br /> What you had from the Shellfish Warden saying that the location was not that important. <br /> It would have no affect on shellfish life if it was installed properly. There is an ex- <br /> isting system there that is even closer to the marsh land and has been there for some <br /> time -- twenty-five years. <br /> Pauline: That was prior to Conservation. <br /> Mr. Benway: Your whole purpose is to protect the shellfish. They could continue to use <br /> that, fix up the house and use the crumby septic system. <br /> Pauline: We are working in the State under Chapter 131, Section 40. <br /> Dick: The last time the Sanchez's came in, they ask us to help them personally. <br /> Pauline: Right. We did. We told them to file. <br /> Atty. Boyd: No, you didn't tell them to file again. I was here. <br /> Pauline: They agreed to file. <br /> Atty. Boyd: They said they would do anything you requested of them. At that point in <br /> time you said this is where we want this, this is where we want that, and we went out and <br /> did that. Now was it you, Mrs. Delory, that went up and looked at the stakes? <br /> Pauline: Pardon me first, Mr. Boyd. Mr. and Mrs. Sanchez came here and they agreed to <br /> file. They said whatever we advised they would do. <br /> Att , Bo d: Yes, but there was no advise to file again at that point. They said that they <br /> agreed to do anything you said to do. And I was here and I will say that. <br /> Mr. Henni an: The serious thing is to avoid additional expense to the young couple that <br /> ant to build. And we all know how high the cost of living is. Mr. Boyd brought that <br /> point out very well. I think there is a way to prevent this additional cost. And I still <br /> hink that you have the authority to issue an Order of Conditions. I request most sincerely <br /> hat you do it. <br /> en: I think that we can reasonably do it. I went down there and looked. The septic tank <br /> here it is is not 40 feet. I don't think the way it was originally laid out was good. The <br /> ay we laid it out on the map, although we are not engineers, might look good. And if we <br /> an give the guy a permit to build from the way it was laid out like that and the way you <br /> ave seen it, which is the best alternative he has; we should be obligated to help him. <br /> Hannigan: That was very generous, and very sincere. <br />
