-2-
S9 3-143
James Fitzgerald
Lots 81 and 89 Mariner Lane, Monomoscoy Island
Agent: Robert P. Bunikis, Eldredge Engineering Co.
Ken: Reads the public hearing notice -- to construct a dwelling with attached garage
and driveway at Lots 81 and 82 Mariner Lane, Monomoscoy Island within '100 feet of
Great River.
Mr. Bunikis: Submitted return receipts to the Board showing that he notified the
abutters. I had a meeting at one o'clock with the Board of Health.
Ken: Were you there Charlie?
Charles: Yes.
Fir. Bunikis: We had discussed this. I had received this letter from the Board of
Health. I had been on vacation last week. It was regarding my application for a
variance. I had asked for a variance of the leaching bed to be three feet above the
ground water as opposed to what Title V requires of four feet. This was done because
I am trying to minimize the fill which is going to go around his well. The Board saw
fit this afternoon to continue a denial and we reached an agreement to go up to our
four feet. So, therefore, the plan in front of you at this moment, of course, reflects
that variance. I can explain the plan. This, actually, is two land court lots which
the Fitzgeralds are combining to build a dwelling on. We have various criteria. Of
course, we have to follow guidelines on one thing or another. We have the existing
well here. The seworage requirement -- and, actually, I've got the expansion area to
be 100 feet away at a minimum. The house -- :this had to be more or less designed by
selecting the area where you could put your disposal system. This was to meet the re-
quirements. Then we could use the rest of the land to try to get a dwelling on it.
Also, 20 feet is a minimum to the dwelling. So that more or less sets the house where
it will be. As a result, I have here 82 feet from the high water mark. Getting back
to the land, you will see some of these spot grading, contours. We go down here at
elevation 4. So, it is rather a low piece of land.
Pauline: This is all marsh.
Mr. Bunikis: No, it is not marsh necessarily.
Pauline: This is Homeyers right here. This is a slip here. That is the Fitzgerald's
boat in the slip. There are two boats in there.
Mr. Bunikis: Yes.
Pauline: Now tell me -- you have some improvised stakes up there . . .
Mr. Bunikis: There is a concrete bound there marking the corner of the lot.
Pauline: Yes, 1 know.
Mr. runiki.s: The property, itself, is very well marked. At present, there is some
scrub pine in here. There is some rather low growth.
Pauline: Now tell me -- down in here, there is a test well.
