This was in <br /> legislation which went into effect on July 15, 1980 which gives a description of a <br /> hazardous waste facility and then goes on in summary to say that Chapter 508 known as <br /> the Hazardous Waste Facility Oiting Bill amends the zoning act by adding a new paragraph <br /> to Section 9. Makes the amendment and provides that a hazardous waste facility is now <br /> permitted as a matter of right in any area of your community presently zoned for indus- <br /> trial use. We interpret the terminology 'presently zoned for industrial use'to mean those <br /> areas zoned for industrial use on the effective date of this act which was July 15, 1980. <br /> A municipality may not adopt a zoning amendment which would exclude a hazardous waste <br />
