TOWN OF MASHPEE PLANNING BOARD
A meeting was held on November 3, 1971, at Mashpee Town
Hall at 8:00 P.M.
Members in Attendance:
Earle Marsters, Chairman
Joesph Delaney
Richardson Jonas
Members Absent:
Thomas Saunders
Arthur Koch
The public hearing was held on the definitive plan for
a subdivision located between Great Neck Road and the Mashpee
River owned by Richard LaTouche. Mr. Nathan Bates appeared
representing the trustees of the reservation. He had several
questions which were answered and did not register any opposition.
The Town Engineer submitted a recommendation that Ashers Path
be paved to provide an alternate route in and out of the subdivision
because of the excessive grades on the other 2 access routes. A
question remains whether Mr. LaTouche can pave Ashers Path and
if so what permission is required. The board promised to pro-
vide Mr. LaTouche with an answer. The Conservation Commission
also appeared at the hearing and submitted an easement to run
with the subdivision. In essence -the easement prohibits con-
struction of work of any kind within 50 feet of the river. Mr.
LaTouche agreed to sign the easement. He also agreed that street
names will be provided before the plan is approved.
Mr. Burden of New Seabury Corporation appeared before the
board with a request that we vary the frontage requirements
on a proposed subdivision. Subsequent to the meeting Mr.
Marsters checked with both the Town Counsel and Mr. Waxer
of the Community Planning Reservation and both stated that
in their opinion the Planning Board does not have the
authorization to vary the frontage requirements. This information
was relayed to Mr. Burden on November, 17, 1971.
