' 5 <br /> M <br /> Mashpee Zoning Shoestring Bay Realty Trust 2 <br /> Board of Appeals owner: Willowhed Development Corporation <br /> 2 SP-o3- 7 <br /> to the substantial disruption or degradation of the marine or coastal environment. <br /> GENERAL FINDINGS <br /> 1. that the property roperty is located at 23 Shoestring Bay road and contains <br /> � <br /> 47,010 square feet. <br /> SPECIFIC FfNDINGS <br /> The Board determined that: <br /> 1. theroP o ed dock will e an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. <br /> 2. the Petitioner met the criteria for granting of a variance of 81 feet to exceed <br /> the allowed 70-foot total length 11mit. <br /> . the proposal has been approved by the Shellfish Constable whose <br /> responsibilities include protection of the marine environment. <br /> 4. theP ro o al has been reviewed by the Conservation Commission to address <br /> impacts on the coastal environment. <br /> . the use is in harmony with the general purpose and intent of the By-laves. <br /> . the owner has rights to maintenance in perpetuity. <br /> 7, filing with the State DEP wetlands Program shall be considered execution of <br /> the Special Permit. <br /> In view of the foregoing, the 1ashpee Zoning Board of Appear found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duty made and seconded, the Zoning Board of Appeals voted unanimously on April 9, <br /> 2003 top <br /> a rant Special Permit. The Special Permit is conditioned upon compliance with <br /> g <br /> plans from The Phoenix Group, 1 ashpee, MA, dated February 10, 2003 as prepared for <br /> 23 Shoestring Bay Road. <br />
