Notice was gi <br /> lven by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, ori March 28, 2003 and April <br /> 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 9, 2003, at which time the following members of the Zoning Board of <br /> App els were present and acting throughout: Robert G. Nelson, Marshall Brem and Zella <br /> Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter oA Section 1 o and the Toy of <br /> Mashpee ZoningBy-laws. <br /> Mr. Gregory Peters represents himself at the hearing. He is seeking relief from <br /> the setback requirements in order to build a 3 bedroom.house. The shape of the lot is <br /> peculiar and a new septic system will be an improvement to the lot. The Board moves to <br /> grant the variances. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> 0 that there are circumstances relating to the shape and topography which affect this lot and <br />
