Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation In the Town of Mashpee, on March 28, 2003, and <br /> April 4, 2003, a copy of which is attached hereto and made a part hereof. <br /> Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> April 23, 2003 and continued to May 28, 2003, at which time the following members of <br /> the Zoning Board of Appeals were Present and acting throughout: Robert G. Nelson, <br /> Richard T. Guerrera and Zella B. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Brie Lubrano, builder represents the petitioners Sylvia and Dennis Neighbors. As <br /> suggested by the Board at the first hearing, the Neighbors have combined to lots to <br /> become one therefore adjusting the lot coverage to a more reasonable request of 0%. <br /> They are proposing to add a covered porch, a deck and a 12" x 22' addition to the existing <br /> non-conforming structure. The Board moves to grant the Special Permit. <br /> SPECIAL L P RMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br />
