F <br /> Town )f P <br /> Mash ee <br /> �A� P � II�G ARD 16 Great Xeck Pvoadfforth <br /> �' APPEAL <br /> �a , Massachusetts 02649 <br /> Decision for a variance <br /> RE Frederick and Lois Glass 41 waterline Drive <br /> Map 120 Parcel 149 and 150 <br /> V-03-61 <br /> Petition was filed on April 7, 2003 by Frederick and Lois Glass for a Variance <br /> from Section 174-25.1.9 of the Zoning By-laws to exceed the70-foot total length limit to <br /> allow for construction of a stairway, pier, ramp and float on property located in an -3 <br /> zoning district at 41 Waterline Map 120 Parcel 149 and 1 Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town ofMashpee, on April 11, 2003 and April <br /> 18, a copy of which is attached hereto and made a part hereof. <br /> A Public Nearing was held on the Petition at the Mashpee Town lull on <br /> Wednesday, April 23, 2003 and continued until May 14, 2003, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Jannes' . Regan III, Robert G. Nelson and Richard Gucrrcra. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts Gen ra.l Laves Chapter 40A Section 10 and the Town of <br /> Mashpee ZoningBy-laws. <br /> Michael Grotle, The Phoenix Group, P.C. represented the petitioners. They are <br /> proposing a 152 foot pier, ramp and float from the upland edge ofthe flagged wetlands, <br /> thus a 82-foot variance is requested. The properties hounding the applicants property <br /> have similar length docks extending across the salt marsh into Great River. The Board <br /> moves to grant the -foot variance. <br /> The Shellfish Constable le acrd Conservation Commission have approved the project <br /> with amended changes. <br /> No comments were received from abutters. <br />
