Notice was given by publication in The Mashpee Enterprise, <br /> newspaper of general circulation in the Town of Mashpee, on April 11, 2003 and April <br /> 18, 2003 a copy of which is attached hereto and made a past hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, Aril 23, 2003 at which time the following members of the Zoning Board of <br /> Pp were present resent and acting throughout: Robert Nelson,n, Marshall Brenn and Zella <br /> lizenherry. <br /> The Mashpee pp <br /> Zoning Board f Appeals issues this Decision pursuant to the <br /> provisions f Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laves. <br /> John Pellegrini represented himself at this hearing. He is requesting a 2.8 foot <br /> variance on the side yard ofhis property in order to build a handicapped bathroom for his <br /> wife who is ill. After some discussion between Mr. Pellegrini and the Board regarding <br /> otherp ssi le areas of putting this addition, the Board determined a variance could he <br /> granted, <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br />
