i <br /> Board of Selectmen <br /> Minutes <br /> November 1 , 2003 <br /> Application t Alter 'remises—Z 's Pub: <br /> Selectman Reveille stepped down for the above referenced hearing. <br /> Vice-Chairman Green presided and opened the Public.Hearing on the <br /> application of Cape Cod Convention Center, Inc., d/b/a Zachary's Pub, <br /> Richard.Halpern, Manager,to alter the premises to include an outside area <br /> for smoking. <br /> j yee Mason, Town Administrator read aloud the hearing notice as <br /> published. Richard Halpern, Manager was present to discuss the <br /> application with the Board of Selectmen. <br /> Correspondence was received from Russell wheeler,Inspector of <br /> Buildings dated November 6, 2003 relative to the.proposed outdoor <br /> smoking area. His comments state that the applicant cannot increase the <br /> occupant load and may pnly surround the smoking.area with a maximum <br /> height of a six-foot fence. Any increase other than what is mentioned <br /> would creed approval by the Board of Appeals. <br /> Mr. Halpern indicated that would like to install a 6' fence made of vinyl <br /> material on the right side of his building to be utilized as an outdoor <br /> smoking area.
