MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />APRIL 26, 2017 <br />Mike Borselli, of Falmouth Engineering represented the applicants for their petition to <br />reconstruct an existing licensed timber walkway on the property. He gave a brief history <br />that the former owners secured a Chapter 91 interim permit, not a'Chapter 91 license but <br />the interim permit which has a more simple streamlined permitting process to allow <br />existing docks to become licensed as a permitted dock in the Commonwealth of <br />Massachusetts. He said when you only obtain an interim permit, a condition of the permit <br />must be converted to a Chapter 91 license within one year of title transfer. The license runs <br />with the land, the interim permit does not. He said when and if this is converted into a <br />license which is the goal, any future property owners deem the benefit of the license for <br />the dock. <br />Mike Borselli said that his client would like to obtain this license but the dock is in <br />disrepair, the posts have lifted from ice, and the decking is old. He said his client would <br />like to rebuild in the same footprint, and believes he can receive a permit for the dock. Mr. <br />Borselli said that his client obtained approval with the Conservation Commission and <br />received positive results for an order of conditions. He said he was advised by the Building <br />Commissioner to obtain a Special Permit with the ZBA. <br />Mr. Borselli described that the new dock will be higher up above the salt marsh and the <br />new material decking will allow sunlight penetration. Mr. Borselli said all of the posts will <br />be 6' x 6' and spaced according to the presented plan. <br />The applicant is also requesting additional parking on his property. Mr. Borselli said that <br />the parking area would allow for cars to park off of the very narrow road. He received <br />comments from the Board of Health to confirm that no vehicles will drive over the septic <br />system which abuts the proposed parking space. Mr. Borselli revised the plan which now <br />depicts a 2 ft. stone wall above grade at the end of the proposed parking area. He said that <br />he submitted the revised plan to Glen Harrington, with the Board of Health and received <br />comments that the wall restricts access over the septic tank and the revised plan was <br />satisfactory. <br />Mr. Furbush read the DPW, the Inspection Department, and the Board of Health comments <br />into the record. Scott Goldstein read the revised Board of Health and Conservation <br />Department, and the Harbormaster comments into the record. <br />Mr. Goldstein made a motion to approve the petition. Mr. Gould seconded, yes. Mr. <br />Pittsley, yes, Mr. Furbush yes. All were in favor of the dock and parking project located at <br />27 Monomoscoy Road West. <br />2 <br />
