MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />JUNE 1, 2017 <br />Katie McBrien would like to add that the houses in her development that are no longer <br />under the restrictions of the deed under which the people had purchased the homes are due <br />to foreclosure, and she does not know if that is significant or not. She said as the <br />development was built the numbers where there and now the numbers are no longer there. <br />Chairman Furbush stated that there are two options, either an insubstantial change or a <br />substantial change to the special permit. Both items trigger two different descriptions. <br />Vice Chairman, Bill Blaisdell explained that if the Board reviews all of the data, and listens <br />to the interested parties, and the Board determines that it's an insubstantial change, the <br />request would aptomatically go through, or if the Board determines that it's a substantial <br />change meaning a substantial change to what was originally approved. <br />Mr. Blaisdell said the next step to the process would be to hold a public hearing that would <br />require any party to present any arguments that you are presenting tonight. Tonight is really <br />a meeting to determine if it's substantial or insubstantial, whether it's a good thing or a bad <br />thing for the Town, a good thing for the homeowners or a bad thing for the homeowners. <br />This would be determined later. That's if it's ruled substantial. If it's insubstantial, then it <br />would go through. A scheduled meeting has to be scheduled within 30 days. The next <br />available date within the 30 -day time frame would be Wednesday, June 28, 2017 and <br />happens to be a regularly scheduled Zoning Board date. This would give the applicant <br />enough time to fill out the application, and send the public hearing notice to the abutters, <br />and advertise in the Mashpee Enterprise. <br />Mr. Blaisdell asked Katie if she understood. Katie said yes. <br />Mr. Walter Abbott, 90 Pinehill Blvd., with the Affordable Housing Committee said that <br />affordable housing receives 16 credits for that development and the Town's goal with the <br />State. If one unit goes away it does not change that goal. If all the units went away and <br />became not affordable, he does not know what will happen and may lose all 16 units. Mr. <br />Abbott said there was a special arrangement made with McShane, even though six (6) were <br />affordable, there is credit for all 16 for the Town. When the two (2) that were lost to <br />foreclosure, the account stayed at 16. <br />Chairman Furbush asked Walter if he had any questions or comments regarding the <br />substantial or insubstantial request. Mr. Abbott said he's concerned that the Town's <br />inventory would be affected. <br />Chairman Furbush as Board Member, Ron Bonvie for his thoughts and he said he will <br />comment at a later date, but is concerned of a "slippery slope" that this could cause.. <br />3 <br />
