Chairman, Jonathan D. Furbush, Vice Chairman, William A. Blaisdell, Board
Member Scott Goldstein, and Associate Members, Brad Pittsley and Norman J. Gould were
present. Board Members Ron Bonvie and Dom DeBarros were absent.
PLEDGE OF ALLEGIANCE
NEW HEARINGS
27 Uncatena Road: Owners, Michael D. and Angela Madnick request a Written Finding
under § 174-17 (extensions or alterations) and § 174-33 (setback from water and wetlands),
of the Zoning Bylaws to allow for installation of a 10 ft. by 10 ft. hot tub on property
located in an R3 Zoning District and the Popponesset Overlay District, Map 123 Parcel 65,
Mashpee, MA.
Mr. Jack Landers-Cauley represented the petition for the homeowner requesting a hot tub
to be installed in -the rear of the property that abuts Dean's Pond. The project was approved
by Conservation and part of that ruling is that the homeowner provides supplemental
planting. They have not started that project because they are waiting for approval by the
Zoning Board.
Board Member, Scott Goldstein read a letter into the record received by an abutter that
resides at 31 Uncatena asking where the water will be drained and she is concerned about
the run-off into Dean's Pond.
Mr. Cauley said he believes they are treated the same way as a swimming pool, and knows
they cannot be drained into the septic system. He agrees that it cannot be drained into the
pond. He said that changing the water requires 3-5 days for the chlorination to dissipate.
He said he could ask the homeowners if they have that information, and to be fair could
continue the hearing.
Chairman Furbush read the Inspection Department comments, and that the Conservation
Commission approved the application. He said that he would like to hear more from
Conservation and the Board of Health in regard to the abutter letter, but they were not
available when the email was received.
Mr. Goldstein said that the homeowner's could check with the hot tub manufacturer.
