MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />JUNE 28, 2017 <br />Vice Chairman Bill Blaisdell asked Mr. Abbott why the figures don't work. Mr. Abbott <br />said that the price that a person can sell their home for is more than what a person at a <br />120% AMI can afford to buy. <br />Mr. Blaisdell said he understands that HAC tried to find a potential buyer that qualifies but <br />HAC also went outside of qualified buyers, and tried to find ineligible buyers who still <br />won't buy because of the deed restriction. He said that it doesn't sound like the formula <br />doesn't work, but the fact that the owner can't sell their house at the price they want to sell <br />it at. <br />Mr. Freeman said that HAC was involved and tried to find an eligible buyer and later sent <br />an email that they could not find a buyer with the house being on the market for 70 days, <br />and waived the 90 -day requirement. It is still deed restricted but HAC does not have to be <br />involved in finding a buyer. It's on the open market. <br />Chairman Furbush thought that the State put together this particular 40B project. <br />Mr. Freeman said that the State is not involved in the subject project. The 40B is really <br />between the Town and the developer. He said there was no State program regarding <br />"moderate" income, but there could have been various subsidy programs that they gave the <br />developer funds under a grant program. <br />-An abutter who resides at 26-D Center St. addressed the Board and- mentioned that her 1 - <br />bedroom unit is listed under the "moderate" income clause and she is also trying to sell her <br />home. <br />Mr. Blaisdell said he would like to know the impact on the Town if there was one change <br />made to the deed rider. <br />Chairman Furbush said that it's important that the Board be consistent. He is concerned <br />that people who are on the same program but fall under the low income "affordable" units <br />would be requesting the same. <br />Mr.. Freeman said that the Board could not make an exception for one of the units up to <br />80% for the 40B because it would violate the program requirement to have at least 25% <br />affordable. There are four (4) moderate units and they are all located in the Main Street <br />Village development. <br />The Board had a discussion to continue the hearing because there are some unanswered <br />questions that they would like to ask the Town Attorney. <br />Mr. Blaisdell made a motion to continue to July 12, 2017 the McBrien's request to modify <br />the 40B at 37 Center Street. Mr. Gould seconded, yes, Mr. Pittsley, yes, Mr. Goldstein, yes, <br />and Mr. Furbush, yes. All were in favor to continue the hearing until July 12, 2017. <br />4 <br />
