MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES JULY 26, 2017 The Board had a conversation regarding the setbacks of the existing structure being 20.7 ft., and moving it to 15 ft. The Chairman said he was concerned with setting a precedent. Mr. Gould said that he respects the Chairman's concerns and knows he's trying to protect the integrity of the Board. Building Commissioner asked the Attorney if the deck was cantilevered. He didn't see the support columns on the plan but wanted to confirm the location of the deck extension. He said that if the deck is designed/engineered correctly it would not make a difference on the depth of the deck. Mr. Mendoza said that the structure could have the post moved back 3 feet so that 3 feet of the deck would be cantilevered. Mr. Bonvic read the Inspection Department, and Board of Health comments into the record. Mr. Blaisdell read the Conservation comments into the record. Mr. Bonvie made a motion to issue a Written Finding to the applicants. Conditioned upon the site and floor plans read into the record. Also conditioned upon the footing and supports of the rear deck closest to the creek as depicted on the plan will be moved 3 ft. further away from the creek thus creating a 3 ft. overhang of the deck, and will have to satisfy the Town Building Inspector of the structural integrity of the deck at the time of the building application. The footings will be 18.4 from the resource area. Mr. Gould second, in favor, Mr. DeBarros, in favor, Mr. Bonvie in favor, Mr. Blaisdell in favor and Mr. Furbush in favor. All were in favor of the specific conditions given to the applicant. OTHER BUSINESS -Approve July 12, 2417 Meeting Minutes Mr. Gould made a motion to approve the meeting minutes. All were in favor.
